These Terms and Conditions govern the use of the digital fitness application 365 FIT BODY. In accordance with the applicable regulations, no value-added tax (VAT) is shown on invoices. The 365 FIT BODY application operates in accordance with the applicable laws of the Federal Republic of Germany.

365 FIT BODY is a digital fitness application that allows users to create, organize, and log their own workouts. The application allows users to: • create their own workouts; • add and organize exercises; • enter the number of repetitions; • enter the weights used; • save the history of previously completed workouts; • create workout templates; • duplicate existing templates; • log the amount of water consumed during the day; • view previous workouts and water entries by date; • access an exercise library with descriptions and video demonstrations; • access free PDF materials for home workouts and gym workouts. The application is available in German and English. The video demonstrations of the exercises serve as visual guidance for users. Certain visual content may have been created with the help of artificial intelligence technology.

A user account is required to use certain features of the application. During registration, the user enters the following data: • first and last name; • e-mail address; • personal password. The password is created by, and known only to, the user. The owner of the application has no access to users' passwords. The user is responsible for safeguarding their access credentials and for all activities carried out through their account.

The user may voluntarily enter the following additional information: • height; • weight; • workout data; • exercises performed; • number of repetitions; • weights used; • amount of water consumed during the day. The application allows weight to be displayed in two units of measurement: kilograms (kg) and pounds (lbs). The user chooses the unit that suits them. The data entered is stored within the user account so that the user can view the history of their workouts and activities. This data serves solely for the user's personal organization, record-keeping, and tracking of activities.

Use of the full version of the application is available via a monthly subscription. The subscription price is: €3.99 per month. New users have the option of a free trial period lasting 7 days. After the free trial period ends, the subscription is automatically activated and the user is charged the monthly amount. Payment is processed via the payment system Stripe. Available payment methods depend on the options offered by Stripe.

365 FIT BODY constitutes a digital service that is provided to the user through the application following registration and activation of the user account. The user agrees that access to the digital content and features of the application may begin during the free 7-day trial period. By activating the service, the user confirms that they wish to have immediate access to the digital content before the statutory withdrawal period expires. The user is informed that, once use of the digital content has begun with their express consent, the right of withdrawal may cease to apply in accordance with the applicable statutory provisions.

The user may cancel the subscription at any time. After cancellation, access to the paid features remains active until the end of the already-paid period, unless otherwise provided by statutory provisions.

Consumers have the statutory right to withdraw from the contract within 14 days of its conclusion regarding the use of the digital service. The user may exercise the right of withdrawal without stating any reasons. If the user expressly requests that provision of the digital service begin before the withdrawal period expires and confirms the conditions under which the right of withdrawal is forfeited, the applicable statutory provisions shall apply.

365 FIT BODY serves as a tool for organizing workouts and providing information about physical activity. The application: • does not provide medical advice; • does not make medical diagnoses; • does not replace the advice of a physician or healthcare professional. The user performs all exercises at their own risk. Users with health issues, injuries, or limitations are advised to consult a doctor before beginning training. The owner of the application does not guarantee any specific results, such as weight loss, muscle gain, or improved physical performance.

Users may add their own exercise names to make organizing their workouts easier. Users are not able to upload their own video content. The user is responsible for the information they enter into the application. It is not permitted to enter unlawful, offensive, or harmful content.

The owner of the 365 FIT BODY application holds administrator rights over the platform. Administrator rights are held exclusively by the owner of the application. The owner of the application may: • manage user accounts; • activate or deactivate access; • grant free access to the application; • remove or delete a user account; • restrict access for users who violate the terms of use; • carry out technical changes, maintenance, and improvements to the application.

Personal data is processed in accordance with the GDPR. The following data may be processed for the operation of the application: • first and last name; • e-mail address; • account data; • workout data; • height; • weight; • amount of water consumed; • other data voluntarily entered by the user. The e-mail address is used for: • registration and account management; • communication related to the service; • important notifications; • customer support. User data is not sold to third parties. The owner of the application reserves the right to amend or supplement these Terms and Conditions due to changes in the law, technical developments, or expansion of the application's functionality. The current version of the terms will be made available to users via the application or the website.
